Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Zeakat platform, website, and services (collectively, the “Service”) operated by Zeakat (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years of age to use the Service. By using Zeakat, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To access the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Description of Service

Zeakat is an AI-powered content creation platform that provides tools for generating, scheduling, and publishing content. The Service includes AI-powered writing tools, a brand vault system, content calendar, and multi-platform publishing capabilities. Features and tools may be added, modified, or removed at our discretion.

4. Subscriptions and Billing

Zeakat offers paid subscription plans billed on a monthly basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscription fees are non-refundable except as required by applicable law.

Each plan includes a monthly credit allowance. Unused monthly credits expire at the end of each billing cycle and do not roll over. Credits purchased as top-up packs do not expire.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to the Service until then.

5. Credit System

AI content generation consumes credits based on the type and complexity of the tool used. Credit costs are displayed before each generation. We reserve the right to adjust credit costs for individual tools with reasonable notice.

6. Content Ownership

You retain full ownership of all content you create using the Service, including all generated text, posts, and documents. You grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

You are solely responsible for the content you generate and publish. You agree not to use the Service to create content that is illegal, defamatory, fraudulent, infringing, or otherwise harmful.

7. Brand Vault Data

Information you store in your brand vault (including brand voice, audience profiles, and content strategy) is used exclusively to personalize AI-generated content for your account. We do not share your vault data with other users or third parties, and we do not use it to train AI models.

8. AI-Generated Content Disclaimer

Content generated by Zeakat is created using artificial intelligence and may contain errors, inaccuracies, or inappropriate material. You are responsible for reviewing, editing, and verifying all generated content before publishing or distributing it. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.

9. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Generate content that promotes violence, discrimination, or illegal activities
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or prompts
• Share your account credentials with third parties
• Use automated systems to access the Service beyond normal usage
• Resell or redistribute the Service without our written consent
• Interfere with the Service’s infrastructure or other users’ access

10. Team Accounts

If you use team features, you are responsible for managing team member access and permissions. The account owner is responsible for all activity conducted by team members under their account, including credit usage and published content.

11. Third-Party Integrations

The Service allows you to connect third-party social media platforms for content publishing. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the actions of third-party platforms, including changes to their APIs or policies that may affect Service functionality.

12. Intellectual Property

The Service, including its design, features, AI tools, system prompts, and underlying technology, is owned by Zeakat and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

13. Account Suspension and Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that harms other users or our infrastructure. We will make reasonable efforts to notify you before suspension, except in cases of severe or urgent violations.

You may delete your account at any time through your account settings. Upon deletion, your data will be soft-deleted and may be permanently removed after 30 days. Active subscriptions will be cancelled upon account deletion.

14. Limitation of Liability

To the maximum extent permitted by law, Zeakat shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

15. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

16. Indemnification

You agree to indemnify, defend, and hold harmless Zeakat and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
